Our clients had arrears of £6,000 and were 5 days away from eviction when they contacted us. The arrears were due to a reduction in family income which had resulted in them being unable to afford their other credit commitments, which had snow-balled to £23,000.
A financial review showed us they could afford their mortgage, £80 per month towards arrears, leaving £275 per month for their unsecured debts. This meant that they qualified for an IVA. An emergency court hearing was arranged and the Judge agreed to suspend the repossession subject to arrears repayments of £80/month and the approval of the IVA from our clients' creditors. Our clients kept ownership of their home and got their debt problems under control.

Our Client's mortgage problems were the result of a martial split. Arrears of over £5,000 were quickly ran up. Now the dust had settled, our Clent was confident of affording the mortgage and was able to pay the arrears by downsizing to a smaller car. The Judge suspended the order on these terms.

Now back in full health and employment, the respossesion order was successfully opposed. We proposed that arrears repayments of £200 per month were affordable, not the £700 demanded by the lender. The judge ruled £250.

We found that consolidating their other debt into a repayment programme freed up enough money for them to be able to afford their mortgage, plus their other credit commitments.
